Acceptable & Fair Use Policy

Summary

This Fair Use Policy is intended to ensure that customers do not use our Services in an unreasonable
manner.
Unless otherwise specified, the terms of this Fair Use Policy apply to all Services supplied by us under
our Agreement with you.
Tesla Telecom reserves the right to vary the terms of the Fair Use Policy from time to time.
Where a customer is considered by Tesla Telecom to be using services in an unreasonable manner (as
described further in detail below), this will be considered a breach of this Fair Use Policy and may give
rise to further actions under the terms of our Agreement with you.

What is Unreasonable Use?

Unreasonable use is any use of the Service which Tesla Telecom reasonably considers to be;
a. fraudulent;
b. excessive; or
c. in a non-ordinary or otherwise unacceptable manner.
Without limitation, examples of such activity include:
a. reselling services provided by Tesla Telecom without written consent so that someone else may
access or use for commercial exploitation.
b. For Fixed Line Services, Cloud Telephony (VOIP) Services, Microsoft Teams Calling & Call Centre
Services and for other Telephony & Hardware Equipment to make and receive calls; running a
Telemarketing or other businesses utilising auto & predictive diallers or other technology which
results in a larger volume of calls. Such use requires prior written consent from Tesla Telecom
and may be subject to further terms and conditions at our discretion.
c. For Mobile Phone Services: The use of SIM cards in a GSM gateway, SIM card box or any other
equipment used to reroute calls and data usage, without Tesla Telecom’s prior written consent.
d. The use of telecommunication services provided by Tesla Telecom to harass or injure, or
otherwise commit an offence against the law.
e. creating dynamic call diversions to multiple terminating points, multiple simultaneous calls
(non-conference call services) bulk messaging, machine to machine communication, or any
non-standard person to person communication as well as the use of Artificial Intelligence
software that is not the origin of communication provided by Tesla Telecom.
f. the Illegal access, monitoring or use of data on any system or network supplied by Tesla
Telecom without our consent.
g. exploiting any network Services or misconfiguring systems that may cause damage or cause
a charging gateway to gain access to intelligent network elements.
h. accessing our networks or systems in a manner that risks the performance, security, and
integrity of our Services.
i. deliberately causing interference, disruption, congestion, or damage to the performance of
systems and networks provided by Tesla Telecom.

Fair Use Policy & NBN Co Limited

You acknowledge where a Service is supplied by Tesla Telecom which, in whole or in part, relies upon
any service and/or product made available by NBN Co Limited (NBN Network Services), that:
a. Your (and/or Your End User’s) usage of the NBN Network Services may fall within certain
parameters set by NBN Co Limited.
b. the download and/or upload speeds available to You (and/or Your End Users) under an NBN
Network Service may be impacted by NBN Co Limited’s enforcement of its fair use policy;
and/or
c. You (and/or Your End Users) may, from time to time, experience slower speeds depending on
usage of an NBN Network Service, the time of day and the type of applications You (and/or
Your End User) are using.

Tesla Telecom’s Rights

1. We reserve the right to apply this Fair Use Policy at our absolute discretion. If Tesla Telecom
reasonably considers that you have used our Services in an unreasonable manner, we may, at
our sole discretion and without consultation with you:
– Suspend or limit access to services provided in accordance with our Agreement to you
and/or
– Terminate the services provided in accordance with our Agreement with you.
2. This “Fair Use Policy” is supplementary to and does not limit any other rights under law of Tesla
Telecom.
